Inheritance proceedings
To prepare an inheritance file, send the death certificate, the heirs' details and documents relating to known assets. The Aequitas Cotroceni team reviews the file and explains the documents and steps required.
The guidance on this page is in English. Downloadable PDF checklists are currently in Romanian.
What inheritance proceedings establish
The procedure identifies the heirs, their rights and the assets forming part of the estate. Civil status records, asset documents and any will are considered together.
Before accepting a file, we check the office's jurisdiction, taking into account the deceased's last domicile and the specific circumstances. Please tell us if a file has already been opened, an earlier certificate of inheritance exists or other countries are involved.
Documents to prepare your request
- Death certificates and, where applicable, documents relating to a predeceased spouse.
- Civil status records of the deceased and the heirs.
- Title documents, cadastral records and land registration decisions.
- Documents relating to shares, vehicles, concessions and burial plots, where applicable.
- Local tax clearance certificates and ANAF certificates.
- The heirs' identity documents and two witnesses with identity documents.
- Declarations accepting or renouncing inheritance, any will and bank statements.
How the process works
- Send the death certificate, information on the last domicile and details of those who may have inheritance rights.
- Send civil status records and documents relating to known assets. Mention any will, inheritance declarations and earlier files.
- We check jurisdiction and the documents, explain what further information is needed and clarify the attendance requirements for heirs and witnesses.
- Once the checks and procedural requirements are complete, we arrange the appointment and specify which originals must be presented.
Frequently asked questions
Can I start without all the documents?
You can send the documents available for an initial review. The office will tell you what is missing; completing the procedure requires the relevant documents and checks.
Does the deceased's last domicile matter?
Yes. The last domicile is relevant to jurisdiction. Send the death certificate and available information before arranging an appointment.
What if there is a will?
Mention it in your first request and send a copy if you have one. The notary reviews the document and its effects during the procedure.
Can someone attend under a power of attorney?
If an heir cannot attend personally, the office must check the circumstances and the required power of attorney. Please request guidance before having it drawn up.
Are witnesses required?
Witness statements are also taken in inheritance proceedings. The office will explain the requirements for witnesses and their identity documents in your case.
How long does it take and how can I find out the cost?
Timing and cost depend on the estate's assets, the documents available and the checks required. After reviewing the information, the office can provide an estimate and explain the next steps.
