Property sale and purchase agreement
Preparing to sell or buy a flat, house or plot of land? At Aequitas Cotroceni in Bucharest, we review the documents and prepare the agreement according to the property's circumstances and the payment method.
The guidance on this page is in English. Downloadable PDF checklists are currently in Romanian.
Selling a property before a notary
A property sale agreement is executed as an authenticated deed. To prepare it, we review title documents, the land register and the parties' details. Tell the office the price, payment method and handover arrangements.
Tell us at the outset if bank finance is involved, if there is a mortgage or if a party will be represented under a power of attorney. This information helps establish the documents and checks required.
Documents to prepare your request
- Title documents, cadastral records and the land registration decision.
- Tax clearance certificates confirming no outstanding liabilities for owners and purchasers, under the applicable rules.
- Land register extract for authentication, obtained by the notarial office.
- Utility bills and proof of payment; certificate from the owners' association.
- Energy performance certificate.
- Bank accounts, identity documents, civil status records and power of attorney.
- For bank finance: the bank representative's details, power of attorney, identity document, credit agreement and amount.
How the process works
- Send copies of the documents available and specify the property, agreed price and payment method.
- We review the documents and explain what else is required, including requirements relating to bank finance, mortgages or representation.
- Once the file is complete, we prepare the agreement and arrange the appointment. The notarial office requests the land register extract for authentication.
- At signing, the parties present the requested original documents. The agreement's clauses are explained and consent is expressed.
Frequently asked questions
Who requests the land register extract for authentication?
The notarial office requests the extract required for authentication. An informational extract can help with the initial review but does not replace the extract for authentication.
Which documents are needed if the purchase uses bank finance?
Tell us the bank and the stage of the credit application at the outset. The office checks the financing documents and the bank's requirements and provides a checklist tailored to the transaction.
Can a mortgaged property be sold?
The circumstances must be checked before the appointment. If the mortgage is in favour of a bank, its documents concerning the sale and, where applicable, discharge of the encumbrances are required.
Can I sign through a representative?
Representation is possible under a power of attorney suitable for the deed. Send it for review before confirming the appointment.
How long does it take and how can I find out the cost?
Timing and cost depend on the documents available, the property's legal position and the transaction value. Send the file information for an estimate and to establish the steps required.
